The web of lawsuits and court rulings involving prediction markets has greatly complicated the issue of jurisdiction. Kalshi has been forced to limit trading in multiple states, most notably Nevada, and the CFTC has gone to unprecedented lengths to protect its licencees. This includes suing nine states directly and issuing emergency orders to reject state mandates.

CFTC Chairman Michael Selig is currently the lone sitting commissioner for an agency that traditionally features a bipartisan group of five. Selig has repeatedly defended both the legitimacy of prediction markets as financial assets and the role of the CFTC in overseeing them. The CFTC under his direction has embarked on a series of rule proposals regarding prediction markets, although detractors argue that the proposed changes still allow for sports contracts and in some ways could be seen as a tightening of the belt to make a Supreme Court review look more favourable.

“It’s not a question of whether innovations like blockchain, artificial intelligence, and prediction markets will transform our markets. It’s a question of where this innovation will take place and who will write the rules,” Selig said during a meeting of the CFTC’s Innovation Advisory Committee on 20 August, which featured the CEOs of Kalshi, Polymarket, DraftKings, CME Group and more.

Entain’s share price tumble follows a broader trend for gaming stocks in recent years. Added to that is a declining interest in the LSEG, as listed companies continue to exit at pace, including Flutter, which removed its secondary listing from LSEG in August.

The gaming giant left for greener pastures in the US, expecting to benefit from higher valuations in the most liquid equity market. But analysts have noted a similar downward trend in Flutter’s share price over time.

Down around 60% in a year, the risk is it becomes just another mid-tier consumer stock on a bigger exchange. “Deeper water doesn’t help if the current is moving somewhere else,” Corfai’s Ben Robinson recently said of Flutter’s stock price.

Coming from the outside, I needed to gather a team to help steer the ship. In the two years since I took on the role, I have been blessed to work with some of the sharpest minds in the industry and I couldn’t be prouder of what we have achieved so far.

I won’t lie, when I first entered iGaming, I had my concerns. Aspects of the industry felt stuck in a state of stasis. People were making money, and as long as that continued to happen and margins were healthy, why innovate? Just keep doing the same things over and over, with marginal improvements when necessary.

As someone with a naturally curious mind, I found this frustrating. However, in a short period of time, I have seen positive changes. Recent regulatory shifts and an increasingly competitive landscape are pushing companies to innovate, and those unwilling to adapt are being left behind.
